Terms and Conditions of Service
1. Introduction
1.1 These Terms and Conditions (“Terms”) apply to all services, repairs, sales, and transactions (“Services”) provided by Gizmoto Ltd (“the Company”, “we”, “our”, “us”) to the customer (“you” or “the Customer”). By engaging with our services, you agree to comply with and be bound by these Terms.
1.2 The Company is registered in England, Registration number 14693266 at Unit 8, Glenbarr Avenue, Leicester. LE4 0AE. Our services are provided in compliance with UK laws and regulations.
1.3 These Terms may be amended from time to time. Any updates will be published on our website or provided to you upon request.
2. Services Provided
2.1 Repairs and Servicing: We provide motorcycle repair and maintenance services, which include, but are not limited to, mechanical repairs, diagnostics, tyre fitting, servicing, electrical repairs, brake servicing, upgrades, accident repairs and general maintenance.
2.2 Parts Sales: We supply motorcycle parts, accessories, and equipment. All parts sold are warranted according to the manufacturer’s terms and conditions unless otherwise stated.
2.3 Quotes and Estimates: All quotes for repairs, servicing, or parts sales are given in good faith based on the information available at the time. We will notify you of any changes to the estimated costs before proceeding with the work. Estimates are non-binding unless otherwise agreed in writing.
2.4 Completion Time: We will provide you with an estimated completion time for repairs and servicing. However, completion times are estimates only and may be subject to change due to unforeseen circumstances or delays in obtaining parts.
3. Customer Responsibilities
3.1 Provision of Accurate Information: You are required to provide accurate and detailed information about your motorcycle, including any previous repairs or issues that might affect the service. Failure to provide complete information could result in delays or failure to diagnose the issue properly.
3.2 Collection and Delivery: You are responsible for delivering your motorcycle to our premises for repairs or servicing and for collecting it upon completion. If we are required to collect or deliver your motorcycle, additional charges may apply.
3.3 Collection of Motorcycles: You must collect your motorcycle within 24 hours on completion of the repairs or servicing. After this period, we reserve the right to charge a storage fee of £12.50 + VAT (£15.00) for every day the motorcycle is left uncollected.
4. Payment Terms
4.1 Pricing: Prices for services and parts are subject to change and may vary based on the model, make, and condition of the motorcycle. All prices include VAT at the prevailing rate unless stated otherwise.
4.2 Payment Methods: We accept payment by credit/debit card, cash, bank transfer. Payment is due upon completion of the work or at the time of purchase of parts, unless otherwise agreed in writing.
4.3 Deposit: We may require a deposit of 20% for certain repairs or services before commencing work. The deposit is non-refundable unless the Company is unable to provide the agreed-upon service.
4.4 Late Payment: If payment is not received within 30 days of the invoice date, we reserve the right to charge interest at a rate of 8% per month until the balance is paid in full. We may also charge any collection fees associated with the recovery of the outstanding payment.
5. Warranty and Liability
5.1 Parts Warranty: All parts supplied and installed by the Company are covered by the manufacturer’s warranty, which varies depending on the manufacturer. Any defects or issues with the parts must be reported to us immediately.
5.2 Service Warranty: We offer a 6 month warranty on all repair and servicing work carried out by us. The warranty covers defects in workmanship but does not cover damage resulting from misuse, accidents, or failure to maintain the motorcycle.
5.3 Liability: We shall not be liable for any indirect, incidental, or consequential damages arising from the services we provide, including but not limited to loss of use, lost profits, or damage to personal property. Our liability is limited to the total amount paid for the service or parts in question.
5.4 Customer’s Own Parts: If you supply your own parts for installation, the Company cannot be held liable for any defects in those parts, nor for any damage caused by faulty parts.
6. Cancellations and Refunds
6.1 Cancellations by the Customer: You may cancel a service or repair appointment by giving us at least 24 hours notice. If you cancel less than 24 hours before the appointment, a cancellation fee may apply.
6.2 Cancellations by the Company: We reserve the right to cancel or reschedule services due to circumstances beyond our control. In such cases, you will be notified as soon as possible, and we will arrange an alternative time or provide a full refund for any deposits paid.
6.3 Refunds: Refunds will be provided if the service or part is deemed faulty or if we are unable to complete the work as agreed. Refunds will not be provided for parts that have been installed, used, or are custom orders.
7. Data Protection and Privacy
7.1 Customer Data: We collect and process personal data in accordance with our Privacy Policy and in compliance with the General Data Protection Regulation (GDPR). Personal information provided during the repair, servicing, or parts purchase process will be used solely for the purpose of fulfilling your order or providing the requested service.
7.2 Communication: By providing your contact details, you consent to us contacting you regarding your motorcycle’s service, repairs, or parts. You can unsubscribe from marketing communications at any time by contacting us or through the opt-out mechanism in our communications.
8. Force Majeure
8.1 The Company shall not be held liable for any failure or delay in the performance of its obligations caused by events or circumstances beyond its control, including but not limited to acts of God, strikes, war, or supply chain disruptions.
9. Governing Law and Dispute Resolution
9.1 Governing Law: These Terms are governed by and construed in accordance with the laws of England and Wales.
9.2 Dispute Resolution: In the event of any dispute, we will attempt to resolve the issue amicably through direct communication. If the dispute cannot be resolved through direct negotiation, the parties may seek mediation or arbitration. This does not affect your statutory rights as a consumer.
